Harmony Legal Pty Ltd trading as Harmony Legal & Associates (Harmony Legal, we, us or our) respects your privacy and takes the security of your personal information seriously.
This Privacy Policy explains how we collect, hold, use and disclose personal information, how you can request access to or correction of your information, and how to raise a privacy concern or complaint.
Where applicable, we handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). As a law practice, we are also subject to applicable professional duties, confidentiality obligations, court rules and other legal requirements.
1. Scope of this policy
This policy applies to personal information we collect or hold through:
- our website;
- online booking and enquiry forms;
- telephone, email, SMS, WeChat and other communications;
- in-person appointments and video meetings;
- conflict checks;
- client engagements and legal services;
- courts, other lawyers, government agencies and third parties;
- payment and trust account arrangements; and
- other activities in the ordinary course of running our practice.
It applies to prospective, current and former clients, other parties to legal matters, witnesses, experts, professional advisers, suppliers and other people connected with our business.
2. Personal information we may collect
The information we collect depends on your relationship with us and the legal matter involved.
2.1 Initial enquiries and bookings
When you contact us, make an enquiry or request an appointment, we may collect:
- your name;
- telephone number;
- email address;
- preferred contact method;
- preferred consultation dates and times;
- the type of legal matter;
- a brief description of your circumstances;
- your date of birth; and
- names and other basic details of the other party, related people or entities, to help us carry out a conflict check.
At the initial booking stage, please provide only the information reasonably needed for a preliminary assessment and conflict check.
Unless we specifically ask you to do so, please do not send identity documents, bank details, court documents, extensive case materials or unnecessary sensitive information through our general website booking forms.
2.2 If you engage us
If you formally engage us, we may collect further information reasonably needed to handle your matter, including:
- your address, date of birth and identity details;
- passport, driver licence or other identity documents;
- family and relationship information;
- information about marriage, separation and children;
- financial, banking, tax, asset, liability and superannuation information;
- employment and income information;
- property, company or trust information;
- health and medical information;
- court, police or government documents;
- information relating to domestic and family violence, criminal proceedings or other legal proceedings;
- correspondence, photographs, audio and video recordings, and electronic records;
- payment information, invoices and trust account records;
- expert reports, valuations and other professional material; and
- other information reasonably needed to provide legal advice or assist with negotiations, mediation or court proceedings.
Because of the nature of legal work, we may sometimes handle sensitive information as defined in the Privacy Act. Where the APPs apply, we collect sensitive information with appropriate consent where it is reasonably necessary for our work, or where collection is otherwise required or authorised by law or an applicable exception. We use and disclose it only as permitted by applicable law.
2.3 Information about other people
Clients may provide information about spouses, former spouses, children, family members, witnesses, business partners or other people.
We may also obtain personal information from other lawful sources, including:
- another party or their lawyer;
- courts and tribunals;
- government agencies;
- barristers;
- experts;
- valuers;
- accountants;
- mediators;
- interpreters;
- process servers;
- investigators;
- publicly available registers; and
- other sources from which information is lawfully obtained.
3. Why we collect and use personal information
We may collect, hold, use or disclose personal information to:
- respond to enquiries;
- assess whether we are able and suitably placed to assist;
- carry out conflict checks;
- arrange consultations;
- verify identity;
- open and manage client files;
- provide legal advice and services;
- communicate with you, other parties' lawyers, courts and relevant professionals;
- prepare legal documents;
- represent clients in negotiations, mediation, litigation and other dispute resolution processes;
- engage barristers, experts, valuers, mediators, interpreters or other professionals;
- manage legal fees, payments and trust account matters;
- comply with court orders, subpoenas, laws and regulatory requirements;
- meet our professional duties and record-keeping obligations;
- manage complaints, risk, insurance and audits;
- maintain our systems, information security and business operations; and
- undertake other activities reasonably related to our practice, where permitted by law.
Unless permitted by law or agreed by you, we do not use personal information collected for a primary purpose for another purpose that is not reasonably related to it.
4. Conflict checks and professional confidentiality
A law practice generally needs to carry out a conflict check before deciding whether it can accept a matter.
For this purpose, we may need to retain the names and limited basic details of prospective clients, clients, other parties and related people, even if we do not ultimately accept the matter.
Contacting us or submitting a booking request does not, by itself, mean that we have agreed to act for you or necessarily establish a solicitor–client relationship.
Once we formally accept an engagement, we owe professional duties of confidentiality in relation to client information and handle that information in accordance with applicable law and our professional obligations. Nothing in this policy limits any confidentiality obligations that may apply before a formal engagement.
5. Who we may disclose personal information to
Where reasonably necessary to provide legal services or operate our practice, we may disclose personal information to:
- our solicitors and authorised staff;
- barristers;
- courts and tribunals;
- other parties and their lawyers;
- mediators;
- experts;
- valuers;
- accountants;
- interpreters and translators;
- process servers;
- investigators;
- medical and other professional service providers;
- banks and financial institutions;
- government departments and regulators;
- insurers and people involved in our professional indemnity insurance arrangements;
- auditors and other professional advisers;
- IT, cloud storage, cybersecurity and software service providers;
- booking, payment and communications providers; and
- other people where required or permitted by law.
We disclose information only to the extent reasonably needed for the relevant service, legal matter or legal obligation.
6. Third-party services we use
We use third-party software and technology services to support bookings, payments, communications and legal services. These currently include the following.
Acuity Scheduling
Some online booking requests for our Principal Lawyer are submitted through Acuity Scheduling. Acuity Scheduling handles the booking information you submit under its own service and privacy arrangements.
Our website forms
Requests for consultations with other lawyers may be submitted through forms on our website and forwarded to our practice for handling.
Stripe
If your booking request has been approved and you choose to pay online by card, your payment may be processed through Stripe. Approval of a request is not final confirmation of the appointment: the consultation is confirmed only after payment is received and we issue formal confirmation.
We generally do not store full card numbers in our own systems. The payment provider handles the relevant payment details under its own security and privacy arrangements.
Microsoft and email services
We may use Microsoft systems, including Outlook and related Microsoft 365 services, to manage email, documents and internal business activities.
Telephone, video and messaging services
At a client's request or where needed for a matter, we may communicate by telephone, video conference, WeChat or other communications platforms.
Depending on their infrastructure, third-party providers may process or store information in Australia or overseas.
7. Overseas handling and disclosure
Some software, cloud, communications and professional service providers we use may have servers, staff or related companies outside Australia. Your personal information may therefore be processed, stored or accessed overseas in some circumstances.
For cross-border family law, estate, property or other international matters, we may also provide information, in accordance with client instructions or as reasonably needed to provide legal services, to overseas:
- lawyers;
- professional advisers;
- experts;
- government agencies; and
- courts or other institutions.
We do not represent that all personal information is stored in Australia. For example, Stripe's published data-processing terms identify the United States as a destination for personal information processed to provide its services. The locations involved in any particular service or matter depend on the provider and the circumstances.
Where the Privacy Act and APP 8 apply to an overseas disclosure, we take reasonable steps in accordance with those requirements.
Third-party technology providers may change their global processing locations from time to time, so we may not always be able to identify every country where information is handled. Where it is practicable to identify additional countries in which likely overseas recipients are located, we will update this policy accordingly. We may also provide further information in the relevant collection notice.
8. Information security
We take reasonable steps, appropriate to the size of our practice and the nature and risks of the information we handle, to protect personal information from:
- misuse;
- interference;
- loss;
- unauthorised access;
- unauthorised modification; and
- unauthorised disclosure.
These steps may include:
- access controls for our systems;
- password and account security measures;
- professional email and cloud services;
- restricting access to people who need the information for their work;
- staff confidentiality obligations;
- file and document management procedures; and
- appropriate cybersecurity measures.
No electronic communication or internet system can be guaranteed to be completely secure.
If you suspect unauthorised access to, disclosure of, or another security incident involving personal information connected with our practice, please contact us promptly.
Where applicable, we assess data breaches and meet our obligations under the Notifiable Data Breaches scheme.
9. Client files and retention
We retain client information and legal files in accordance with applicable laws, professional duties, risk management requirements and business needs.
Under the professional rules applicable to Queensland solicitors, a law practice may generally destroy client documents seven years after the engagement has ended, unless client instructions or other legal obligations require otherwise.
Some information may be kept for longer than seven years because of:
- legal requirements;
- ongoing legal proceedings;
- limitation periods;
- wills, estate planning documents or other documents with long-term legal effect;
- professional responsibilities or risk management needs; or
- other reasonable legal grounds.
Trust account records and related documents are also retained for the periods required by applicable law.
When personal information is no longer needed for any lawful purpose and there is no legal requirement to retain it, we take steps to securely delete, destroy or de-identify it, so far as reasonably practicable.
10. Payment information
If you pay online by card, we may use a third-party payment provider to process the transaction. The provider may collect directly:
- the cardholder's name;
- credit or debit card details;
- the payment amount; and
- technical information relating to the transaction.
We generally receive payment confirmation, transaction records and information needed for our accounts, rather than storing full card details ourselves.
11. Cookies, website data and technical information
When you visit our website, the website or its technology providers may automatically collect limited technical information, such as:
- your IP address;
- browser type;
- device type;
- operating system;
- pages visited;
- the date and time of your visit; and
- referral information.
This information may be used to:
- maintain website security;
- enable the website to function;
- understand how the website is used; and
- improve our website services.
Our website includes a Google tag for website measurement. Depending on the connected services and settings, it may use cookies or similar technologies and send website usage and technical information to Google. Google's information about its handling of data from partner websites is available at https://policies.google.com/technologies/partner-sites.
You can manage or delete cookies through your browser settings. Blocking cookies may affect some website or booking features. Browser cookie settings do not necessarily prevent all collection of technical information. If we introduce other non-essential tracking tools, we will update the information provided about those tools and the choices available to visitors.
12. Marketing communications
If you agree to receive our news, event invitations or other promotional information, we may use your contact details to send those communications.
You can ask to stop receiving marketing communications at any time. Opting out does not affect necessary legal, billing or administrative communications about an existing matter.
13. Access to your personal information
You may request access to personal information we hold about you. To protect your privacy, we may first need to verify your identity.
We may be unable to provide some or all of the information where an exception under applicable law applies, for example where disclosure may:
- affect another person's privacy;
- involve legal professional privilege;
- affect existing or anticipated legal proceedings;
- breach a law or court order; or
- fall within another lawful ground for refusing access.
Where applicable, we deal with requests within a reasonable period and generally aim to respond within 30 days.
14. Correcting your personal information
Please contact us if you believe that information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading. Where applicable, we take reasonable steps to verify and correct it.

- how you would like us to address the issue.
We acknowledge complaints and aim to deal with them within a reasonable time. We generally aim to respond within 30 days. If a complex matter requires more time, we will let you know.
If the Privacy Act 1988 (Cth) applies to the matter and you are not satisfied with our response, you may be entitled to complain to the Office of the Australian Information Commissioner (OAIC). The OAIC generally expects you to first give the organisation a reasonable opportunity to address your complaint.
16. Relationship with legal obligations
This policy is a general explanation of how we handle personal information. It does not reduce or replace any obligations relating to:
- solicitor–client confidentiality;
- legal professional privilege;
- court orders;
- professional conduct rules;
- the Legal Profession Act and related legislation; or
- other applicable laws.
If this policy conflicts with a legal or court requirement that applies to us, that requirement prevails.

We may update this policy from time to time to reflect:
- changes to legal or regulatory requirements;
- changes to our business or services;
- changes to the software and technology services we use; or
- changes to how we handle personal information.
The latest version will be published on our website with its last updated date.

律师事务所在决定是否能够接受某项法律事务之前,通常必须进行利益冲突检查。
为此,我们可能需要记录潜在客户、客户、另一方及相关人士的姓名和有限的基本资料,即使最终本所没有接受该法律事务。
联系本所或提交预约申请本身并不代表本所已经同意担任您的律师,也不一定建立 律师与客户关系。
在本所正式接受委托后,我们对客户资料承担专业保密义务,并会按照适用法律及律师专业责任处理相关资料。本政策不会限制正式接受委托前可能适用的保密义务。
5. 我们可能向谁披露个人资料
在提供法律服务或营运本所业务所合理需要的情况下,我们可能向以下人士或机构披露个人资料:

- 出庭大律师;
- 法院及审裁机构;

6. 本所使用的第三方服务
为了提供预约、付款、通讯及法律服务,本所会使用第三方软件及技术服务。
目前包括:
Acuity Scheduling
主任律师的部分网上预约申请通过 Acuity Scheduling 提交。
Acuity Scheduling 会按照其自身的服务及隐私安排处理您提交的预约资料。
本所网站表格
其他律师的预约或咨询申请可能通过本所网站的网上表格提交,并传送给本所处理。
Stripe
如果您的预约申请已通过审核,并选择网上银行卡付款,付款可能通过 Stripe 处理。申请通过审核并不等于预约正式确认;只有收到付款并由本所发出正式确认通知后,咨询预约才正式成立。
本所一般不会通过自己的系统保存完整的信用卡号码;相关付款资料由付款服务供应商按照其自身安全及隐私安排处理。
Microsoft及电子邮件服务
本所可能使用 Microsoft 系统,包括 Outlook 及相关 Microsoft 365 服务处理电子邮件、文件及内部业务工作。
电话、视频及即时通讯
在客户要求或案件需要的情况下,本所也可能通过电话、视频会议、微信或其他通讯平台与客户进行沟通。
第三方服务供应商可能按照其自身基础设施,在澳大利亚或澳大利亚境外处理或储存相关资料。
7. 境外处理及披露
部分本所使用的软件、云端服务、通讯平台或专业服务供应商可能在澳大利亚境外设有服务器、人员或关联公司。
因此,您的个人资料在某些情况下可能被澳大利亚境外的服务供应商处理、储存或访问。
此外,在涉及跨境家庭法、遗产、财产或其他国际法律事务时,我们可能按照客户指示或为提供法律服务所合理需要,将资料提供给澳大利亚境外的:

在适用的情况下,本所会按照法律要求评估资料泄露事件,并履行适用的 Notifiable Data Breaches 要求。
9. 客户档案及资料保存
本所会按照适用的法律、专业责任、风险管理及业务需要保存客户资料和法律档案。
根据适用于昆州律师的专业规则,除客户另有指示或其他法律义务要求外,律师事务所在委托结束后通常可在 7 年 后销毁客户文件。
某些资料可能因为以下原因保存超过7 年:
- 法律要求;
- 尚未结束的法律程序;
- 诉讼时效;
- 遗嘱、遗产规划或其他具有长期法律效力的文件;
- 专业责任或风险管理需要;或
- 其他合理法律原因。
信托账户及相关记录亦会按照适用的法律保存期限保存。
在个人资料已经不再为任何合法目的所需要,并且法律没有要求继续保存时,我们会在合理可行范围内安全删除、销毁或去除身份识别信息。
10. 付款资料
如果您使用网上银行卡付款,本所可能使用第三方支付服务供应商处理交易。

您可以要求查阅本所持有的关于您的个人资料。
为了保护您的隐私,我们可能需要先核实您的身份。
在适用法律规定的例外情况下,我们可能不能提供部分或全部资料,例如披露可能:

- 影响现有或预期的法律程序;
